Cost reimbursement in tax cases
If a person or a company appeals a decision in a tax or duty case and the appeal is largely upheld, the State normally covers 100% of the costs for expert assistance, including attorney fees. If the appeal is not largely upheld, only 50% of the costs for expert assistance are reimbursed.
It is a condition for reimbursement that the person or company appealing a decision in a tax or duty case is fully responsible for the expert’s assistance. This is always the case when Bachmann/Partners Advokatpartnerselskab provides expert assistance to a client.
Reimbursement can be applied for in appeal cases to the Danish Tax Appeals Agency, the Tax Appeal Board, or the National Tax Tribunal, as well as cases brought before the courts. In addition, reimbursement may be applied for in cases brought by the Ministry of Taxation to the National Tax Tribunal, as well as cases in which the Danish Tax Appeals Agency, the Tax Appeal Board, or the National Tax Tribunal have been requested to reopen a previous decision.
Reimbursement may also be applied for in other cases, for example, cases brought before the Court of Justice of the European Union.
For expert appraisals, it is possible to apply for 100% cost reimbursement before the case begins.

Cost Reimbursement – When Others Are Responsible for the Tax Claim?
There is a possibility for, for example, employers to provide a tax-free grant for handling tax cases that affect the employee. At the same time, the employee can apply for 50% cost reimbursement. However, the employee can never receive more than 100% of the costs covered by others for handling their case.
Cost Reimbursement – When Is the State Grant Paid Out?
The grant is applied for once an attorney invoice has been issued. Processing time is often 6–12 months before the grant is paid.
Cost Reimbursement – Responsibility for the Attorney’s Fee
A fundamental condition for receiving cost reimbursement is that the client is responsible for the attorney’s costs. If the client is not liable, reimbursement cannot be applied for.
